Causa Mousiana (1608)[1][2] est iudicium magni momenti in iurisprudentia Anglica. Quae res auxilium defensioni necessitatis publicae in torto tulit.[3]



  • Res.—Portitor quadraginta septem homines in Tamesi ad Londinium traiciebat, inter quos quidam Mouse, cum tempestas ante Gravesend linteri minari inciperet. Alii vectores ad linterem servandam iacturam oneris fecerunt. Mouse autem, quia eius capulus centum tredecim libras sterlingorum continuerat, vectorem ob damnum in ius vocavit.

  • Iudicium.—Curia decrevit aliquem in causis necessitatis ad vitas servandas agere posse, et non obnoxium esse, quamquam portitor ipse obnoxius esset,[4] qui damnum rependere adiuvare debuit.[5][6]
